These Conditions of Use ("Conditions") govern how you access and use the services provided by Dukasasa, including our hosted eCommerce website platform, tools, and support services (collectively, the "Service").

By accessing or using the Service, you confirm that you have read, understood, and agree to be bound by these Conditions. If you do not agree, you may not access or use the Service.

1. Eligibility

To use our Service, you must:

• Be at least 18 years old or a registered legal entity in Kenya.

• Have the legal capacity to enter into a binding agreement.

• Provide accurate and complete information during registration.

2. Permitted Use

You agree to use the Service only for lawful purposes, including:

• Creating and operating an online store.

• Managing your products, orders, and customers.

• Using our platform in accordance with applicable Kenyan laws and these Conditions.

You must not:

3. User Content

You are responsible for all content posted or uploaded to your Storefront, including:

• Product descriptions, images, and pricing.

• Customer data and communications.

• Business information and marketing materials.

You represent that you own or have permission to use all content you upload. You grant us a license to host, display, and process your content as needed to provide the Service.

4. Service Access

• We aim to provide reliable and secure access to your Storefront at all times.

• We may perform maintenance, upgrades, or emergency interventions that could impact availability.

• We are not liable for any temporary downtime, loss of access, or data issues beyond our control.

5. Account Security

• Keep your account login details confidential.

• Notify us immediately of any unauthorized access or suspected breach.

• You are responsible for any activity under your account.

6. Changes to the Service

We may add, remove, or update features of the Service at any time to improve performance, security, or user experience. Where changes significantly impact functionality, we will provide advance notice.

7. Termination of Access

We reserve the right to suspend or terminate your account if:

• You violate these Conditions.

• You fail to pay for your subscription.

• We suspect fraud or illegal activity.

Upon termination, your access to the Service and your Storefront may be deactivated, and your data may be deleted after a grace period.

8. Limitation of Liability

• Use of our Service is at your own risk.

• We are not liable for indirect, incidental, or consequential losses.

• Our total liability is limited to the amount paid to us by you in the previous 3 months.

9. Governing Law

These Conditions are governed by the laws of the Republic of Kenya. Any disputes will be resolved in the courts of Nairobi, Kenya.
